In July 2020, the Ministry of Consumer Affairs suggested a new set of regulations that aims to halt sponsorship partnerships between sports teams and gambling companies. This included shirts, equipment, and stadium branding. The ban was confirmed a couple of months later, in October.
A month later, in November, The Royal Decree on Commercial Communications of Gambling Activities was approved, bringing a set of restrictions on advertising and marketing campaigns. As far as defined in the Royal Decree, marketing campaigns featuring athletes and celebrities were permitted until April 1, 2021, whereas advertising via third-party websites was allowed until May 1, 2021. Sports team sponsorships were permitted until September 1, 2021.
July 2021 brought a new range of restrictions, this time focusing on the online gambling market of Spain. It was suggested that operators must implement systems to enable consumers to set time and max loss limits at the start of every betting session for 24 hours. Also, it was proposed to establish the thresholds for “intensive play”. Should customers reach those, an operator would be required to notify them.
The package was approved less than two years after that, in March 2023. The new guidelines encompass mandatory, pre-commitment, time, and loss limits as well as new “intensive play” thresholds. Two months before that, in January 2023, the regulations were expanded to prohibit the use of promotional bonusing and limit gambling ads on radio and TV to a period between 01:00 and 05:00.
