US Nevada Online Casinos
Nevada might be considered the most Liberal state on gambling out of the fifty, but honestly, that’s pretty debatable. For one thing, they don’t have a state lottery, but perhaps that’s just because the state doesn’t want to be seen as competing with the casinos.
Another reason that we don’t consider them the MOST liberal state on gambling is because, unlike states such as New Jersey and Delaware, they do not have fully legalized and state-regulated online casinos yet! Nevada does have online poker, which believe it or not, does not draw a ton of revenue, but it has yet to have any other kind of online casino gambling.
Not surprisingly for the state that started it all, the codes as relate illegal gambling which we first published here.

"NRS 465.092 Accepting, receiving or allowing another to accept or receive wager from person physically present in this state prohibited under certain circumstances; penalty.
1. Except as otherwise provided in NRS 465.094, a person, alone or with others, shall not knowingly, within or outside of this state:
Accept or receive, directly or indirectly, through any medium of communication a wager from another person who is physically present within this state; or
Allow a lessee, agent or employee to accept or receive, directly or indirectly, through any medium of communication a wager from another person who is physically present within this state.
2. If a person engages in conduct in violation of subsection 1 and the person is outside of this state at the time of the offense:
The offense shall be deemed to commence outside of this state;
The offense shall be deemed to be consummated within this state; and
The person may be prosecuted within this state pursuant to the provisions of NRS 171.015.
3. A person who violates the provisions of this section is guilty of a misdemeanor.
NRS 465.093 Placing, sending, transmitting or relaying wagers to another person prohibited under certain circumstances; penalty.
1. Except as otherwise provided in NRS 465.094, a person, alone or with others, shall not knowingly:
From within this state, place, send, transmit or relay through a medium of communication a wager to another person or an establishment that is located within or outside of this state; or
From outside of this state, place, send, transmit or relay through a medium of communication a wager to another person or an establishment that is located within this state.
2. A person who violates the provisions of this section is guilty of a misdemeanor."
For those of you who might think those codes seem unnecessarily complicated, it is important to realize that they were NOT originally written to address online gambling because online gambling didn’t exist yet.
The Supreme Court has since overturned PASPA, the Professional and Amateur Sports Protection Act, but at the time that it was in place, only states with legalized and regulated casinos had the opportunity to begin sportsbook operations within a certain timeframe mandated by PASPA. Nevada was the only state to actually already engage in full sportsbook operations, so obviously, they availed themselves of the opportunity to be allowed to continue to do that. Montana ran something called a sports lottery and New Jersey, for whatever reason, did not pass any state laws authorizing a sportsbook in time.
Anyway...
...the obvious concern for Nevada was that people from out of the state, or perhaps even out of the country, would, “Call-In,” to casino employees, or other people, and essentially making sports wagers through them. It’s for that reason that Nevada sportsbooks would not and still will not discuss betting lines with someone over the phone.
Sport Laws
The rest of the laws are focused on sports bettors calling in to make bets via other bettors, which obviously is something that happened pretty routinely anyway, but is technically illegal in the State of Nevada. The language of these codes is such that, inadvertently, they didn’t really need to be changed to explicitly cover online gambling not authorized and regulated by the state, as well.
It’s difficult to say...
...whether or not Nevada will legalize full-on online casino gambling simply because there are so many Micro-Casinos scattered throughout the state that already essentially cater to, “Convenience,” players. There are also a number of little bars, particularly in the greater Las Vegas area, with bartop games such as Video Poker, Keno and sometimes Slot games . Nevada is actually one state in which the legalization and regulation of online gambling (and people within the state choosing to avail themselves of that ability) could harm small and independently-owned businesses by pulling physical customers away.
The thing about the other states
Pennsylvania, New Jersey, Delaware and to fully legalize online gambling so far is that the casinos in those states are either spread out (Delaware, Pennsylvania) or confined to one very specific area (Atlantic City, in the case of New Jersey). For those states, it makes more sense to legalize and regulate online because a significant percentage of the population of those states are not within a stone’s throw of a place that they can gamble.
Therefore...
...online is a good way to keep that business within the state when the target market may be closer to an out-of-state casino than one located within state.
In any event, while we have never heard of anyone getting in any trouble for acting as a mere player online in the State of Nevada, some online casinos who are willing to do business elsewhere in the United States will not accept Nevada players. Bovada is one of the most notable examples, and that is probably for a few different reasons:
- Bovada offers sportsbetting, which Nevada has.
- Bovada offers online poker, which Nevada has.
- Bovada generally stays out of states that have licensed and regulated online gambling.
It seems quite likely that Bovada may be hoping to operate within some of the online casino states that will be coming up sometime down the line, but in order to do that, they don’t want to irritate any of the states who currently have legalized and regulated online gambling.
