The State of Utah is easily one of the most restrictive when it comes to gambling, in fact, they include specific provisions in their laws that deal with Internet gambling.
The state actually goes so far as to opt out of Internet gambling ahead of time if the Federal Government chooses to legalize (specifically) and regulates same, provided the government creates a provision allowing states to opt out.
76-10-1102. Gambling.
(1) A person is guilty of gambling if the person:
(a) participates in gambling, including any Internet or online gambling;
(b) knowingly permits any gambling to be played, conducted, or dealt upon or in any real or personal property owned, rented, or under the control of the actor, whether in whole or in part; or
(c) knowingly allows the use of any video gaming device that is:
(i) in any business establishment or public place; and
(ii) accessible for use by any person within the establishment or public place.
(2) Gambling is a class B misdemeanor, except that any person who is convicted two or more times under this section is guilty of a class A misdemeanor.
As everyone can see, gambling is a Class B Misdemeanor, which can be punished with up to six months in jail and fines of up to $1,000. Repeat offenders can be found guilty of a Class A Misdemeanor and punished with up to one year in jail and fines of up to $2,500.
Earlier this year, there was a bust of three internet cafes in which 150 machines were confiscated, though no arrests were made at the time.
A similar bust took place late last year, but those arrested merely for the gambling operations (there were drug operations connected) were cited for gambling and released.
With all of that however, we can find no instance of mere players being arrested for gambling online in their homes. However, the law is completely unambiguous that all forms of gambling are illegal and that, even if it comes to be federally expressly legalized and regulated, Utah does not want it. It also cannot be ignored that Utah added online gambling into their laws specifically.
