I had been playing with Oshi casino for a while, i found them on a google search. everything seemed cool until i was bored one day and started reading the terms and noticed USA players were banned. when i questioned support they never respond they just keep ignoring me and close live chat. Does anyone else find this fishy? My main concern is why do they still continue taking deposits from USA players when they know they are breaking the law? Am I wrong for feeling they should refund deposits if a player has never cashed out?

USA players are not allowed, there may be a loop hole because of crypto transactions which make it more anonymous until you need to cashout over $1000 and send documents and then this will show you are from the US and winnings could be confiscated. Best to play at crypto-friendly casinos specifically for USA players.

I beleive you are mistaken because there terms clearly say even bitcoin deposits from USA players are not allowed. Their are even other casinos that have the same license as them that i found on google but when I try to visit their site it blocks me and says players from my country are blocked. This sounds illegal and isnt this something lcb should help players with?

I'm a little confused because of your previous reply, you sounded like this is something new to you. if thats the case I would love to work with you on figuring out what we can do because this seems like it can be a very big problem if not fixed quickly.

OK Melcb now I am really confused as to what is going on here. I found other complaints which you were involved in the discussion and the casino was blacklisted and had to refund the player. When I googled those casinos I find out that all are under the same gaming license so please respond ASAP.

I did make my complaint clear that this casino should have to refund my deposits or be blacklisted just like you did to other casinos under their same license

Hey Melcb this doesnt seem like the correct action to take judging from other complaints by other users on the same issue as mine. You along with other administrators agreed that the casino should refund or be blacklisted. Dont shoot the messenger, im not being rude im just helping you out because im sure you dont remember every single persons complaint.

USA players can't gamble online because their country decided so. They know exactly what it's all about and if they decide to break their own laws then they shouldn't complain when they get caught. I'm getting tired of hearing about all these americans whining about casinos this or casinos that while it's them that went to gamble against their own laws. They shouldn't be refunded. Ask a lawyer for fun. An american player that decides to go against the law to do somehting prohibited do at his own risks and has only himself to blame if something happen. It's not like it's something knew or not known.

one more thing i would like to add. from other complaints here in the forums it has already been established that these casinos are in violation and have a responsibilty to stop this but they clearly refuse even after the moderators have been on the players side. so your also mad at the moderators here mr happy?

Hi Miss Melcb,
Just wanna give out a comment which I am 101% sure. Oshi Casino even on a 0.001 mBTC cash out or a $ 20 USD cash out requires all documents uploaded on the profile page. Even if you only use crypto and not any fiat deposits. So Oshi can not reason out anonimity of cryptos. Tsk tsk.

I have actual proof that any casino under the Direx N.V master license must refund all USA players their bitcoin deposits or they will be immediately suspended. I have an email from the CEO of a big name casino confirming the serious legal issues of this and the successful refund to the player. Im hesitant if I should release this or not because I did not ask permission to post it publicly.

Well, I personally believe each and every casino should be obliged to refund all deposits made from the very start by a customer who, in case hits the jackpot on a certain game, would not be paid at all. That being said, this shouldn't need any governing body, any laws nor any CEO's nor Managers. This is just logical, rational and ethical. If someone would contradict this statement, then he simply admitted though indirectly, but of course obviously, that he and the rest of the casino he works with are illogical, irrational and unethical. I wouldn't want to deposit on a casino hoping for a big win and once it happens will be encountering a nightmare as such! On the other hand, any legitimate casinos wouldn't dare collect and keep a deposit from someone who they know of course wouldn't have a chance to take home the jackpot in case won. Because that's too evil. This is just my point of view. Not speaking in behalf of anybody else. I just wanna help out this girl as I think she deserves all the right to demand refunds from the very first deposit up to the last. Well, just a heads up girl, This happened to me on Videoslots casino. I was noob way back, I did not know about NetENT and all that staff. I played it and it allowed me. It was a few months later when I knew it was restricted in my jurisdiction. So I tried to check it on other casinos and I cant seem to find the slots. I was then informed that duie to the restriction it is not viewable on my end on other casinos but Videoslots. They did not refund a single cent. Evil! I moved on! I have it donated instead. They disabled my account. LoL! Goodluck girl! I wish you the best! ÜÜÜ

The smoking gun? Wow. That would be interesting since I think you are purposefully avoiding US detection, as your flag under your profile currently indicates Russia Federation.
Look, here are a few simple questions:Did you sign up as a US player in your profile?
When it told you it doesn't accept people from your country did you ignore it?
Did you win or lose?
If you were knowingly deceptive, that law you quote does not apply. Many people travel, myself included. I am Irish, I have major clients in Geneve and Budapest and a partner in the US and family in Canada. I play from all those places and due to the nature of my work, I also often have to use VPN to communicate and fxp files to them within their realm.
Even though, I play from all those places using BTC. I am Irish. That is what applies to me. Oshi casino is solid and honest. Once I did the documents, it was smooth sailing.
You can VPN it up all you want, but that doesn't make you Russian and US laws apply, which clearly have state by state laws regarding online wagering. Additionally, the deposit return rule of law is not there so that if you lose you get your money back. It is there so that if somehow you were ignorant of all things and still willfully deposited somewhere where you would be committing an illegal action to do so, you could get your deposit back.
Using it as some safety net to return your lost wagers is really beyond the pale. It is truly interesting that you want the whole casino removed from the system and shows your hand a bit more than you think, so does this "smoking gun" thing. You don't sound like someone concerned, you sound like a paper tiger trying to force a situation. And lastly, your statements clearly show you knew before you signed up to any of the coin casinos what the rules are and did it anyway.
My guess, you lost. You then went to pull the innocent victim routine. Oshi said no thanks, bye. You got mad and said you will get them and their little doggie too and here we are.
It won't work. Oshi is stable, honest and simple.
And I apologize to everyone else, but I too am a bit tired of these ruse being used when all it does is dull response to legitimate complaints and make things more convoluted for us who wager responsibily and are adult enough to lose.3.8/ 5

What the hell does this have to do with the casino. If your asking if I used vpn at casino then my answer is NO I didnt use vpn, duh.
All this person wants to do is make me look like a sore loser, he obviously cant read because i already posted the details of this situation. I want all of the real players out ther to pay attention to the words this guy says because he is a certified casino sympathizer that blames innocent players.

Lets get one thing straight, just because these casinos are good to people in your country it is not fair to come on here talking trash about USA players because we did not know about the gambling laws before hand. You act like this is a topic of discussion in everyday normal life. The average player goes to work 8 to 10 hours a day comes home relax eat and spends time with family then off to sleep to wake up and repeat the process, most people i spoke with played mostly on weekends just like myself. When you see USA players on here it is because we have already been screwed by a casino so we start searching google for answers and now here we are. I will update this post with proof from the Direx, N.V casino owner admitting violation and refunding all my deposits along with proof from other players too. Since Mbit and Bitstarz breached their contract with the Curacao Goverment the contract between player and casino is illegal and thus void.I removed Oshi Casino, BobCasino/Playamo from the list because they have both corrected there violations and have done right by players.
In the meantime read this....
In April 2011, the FBI indicted the "founders of the three largest Internet casino companies doing business in the United States—PokerStars, Full Tilt Poker, and Absolute Poker...with bank fraud, money laundering, and illegal gambling".[56] In 2006, the United States enacted the Unlawful Internet Gambling Enforcement Act (UIGEA), yet casino companies continued to operate until the 2011 indictment. Similar to the 2011 indictment, the Justice Department is collecting evidence and building a case against the Bitcoin gambling sites before they launch an indictment. The UIGEA does not prohibit Internet gambling, but it does make it illegal for an online gambling business to knowingly accept funds transfers.[57]The Bitcoin gambling sites are currently circumventing this legislation by keeping their funds in bitcoin cryptocurrency wallets. However, in order for these sites to exchange their Bitcoins for a fiat currency they must use a financial exchange, so even by receiving their earnings with Bitcoin, the online gambling sites may come into jurisdiction of the UIGEA if the gambling business accepts payment through "(i) automated clearing house (ACH) systems, (ii) card systems, (iii) check collection systems, (iv) money transmitting businesses, and (v) wire transfer systems."[58]
The Illegal Gambling Business Act includes Bitcoin gambling sites because the act broadly prohibits all gambling businesses that are in (i) "violation of the law of a State or political subdivision in which it is conducted; (ii) involves five or more persons who conduct, finance, manage, supervise, direct, or own all or part of such business; and (iii) has been or remains in substantially continuous operation for a period in excess of thirty days or has a gross revenue of $2,000 in any single day."[59] Under IRS regulations Bitcoin and other VCs are treated as property, so losses and gains must be calculated to determine the value of the virtual currency. If an online gambling business earned the value of at least $2,000 dollars in Bitcoin "in any single day", they may fall under this act.

Ok I am a bit confused right now, I started this post/complaint several days ago and have not received a response from an Admin offering help. However, what I do see is alot of Admin activity praising these same casinos. These casinos should immediately be marked as rogue and all promotions canceled until they block players from banned countries. Remember there is a reason why they refuse to block players from banned countries, they must be making alot of money from them so they dont care if they break their gaming license agreement. This needs to be stopped

Ok ok, you honestly need to tone it down and stop opening new topics and stop blaming the one who is trying to help and who gave you the platform to speak up.
Mind LCB is a free mediator and we give our best to resolve all complaints.
It is crucial to exercise patience as these things can take time. Not to mention there was an igaming show last week and most casino reps were away.
So lets address all major issues here:
1. These casinos do not take USA players per their T&Cs , and its every player's responsibility to do their due diligence before playing.
2. Casino should refund player deposits that shouldn't have be taken in the first place
3. Said casinos should additionally prevent players coming from restricted countries, from depositing at all.
Num 1 is solely your responsibility, as far as num 2 and to my understanding this your case ( as u mentioned in the other topic that you want your deposits refunded ), we did get in touch with the Representative re your case, and we are waiting for them to reply at the said topics. You should also private message Sydney all the complaint details and user names for said casinos. It migth speed up the process. As far as num 3 , we are also in talk with a few casino reps regrading this, and it is our hope they will recognize the necessity to improve their processes. We will certainly keep the community up to date.
In the meantime this topic will be merged with the OP you started few days ago.

I see what you are trying to do by telling me to calm down, your trying to make it seem like i am coming against you guys so you can have a reason to ban me and delete this post. Its not going to work because i have been nothing but professional and i am only pointing out the obvious. We are all human and we make mistakes, but to get mad at me for pointing out your mistakes is just flat out wrong. Here is the biggest problem right now, you beleive anything the casino tells you and you beleive any proof they show you as well. You put too much trust into the casino than you do your members/players. A player can never get a fair chance if your always going to beleive what the casino says.
One more important fact to note. The Direx, N.V. platform which all these casinos use has had the setting to block banned countries and almost all casinos have this turned on except mBit and Bitstarz so they need to be held accountable for knowingly doing this.

I have spoke with both mBit and Bitstarz many times and they have made it clear that they will never refund my bitcoin deposits because they do not accept usa players and said I breached their T&C's. HERE IS WHERE THEY SCREWED UP. Since having GEOBlocking turned on just like Playamo and BobCasino do is ian nternational law and in their T&C's with the Curacao Gaming Commission. They have breached their contract therfore their license is not valid at this time. One more thing, just because alot of players from other countries love them dont make them saints because they are clearly stealing from alot of usa players but thats besides the point now. The main issue now is that they have breached their contract with the Government of Curacao. They are illegally doing business and all players are contributing to their criminal activities.

Hello MissBitchcoin,
We don't understand why you don't want to provide us with your usernames, since all players who post their complaints in this forum do so. If you want us to help you with refund of your deposits, that's the only way how we can do it.
Otherwise, there's no point in continuing this discussion on the forum.
Also, it's not true that the licenses of these casinos have been suspended. They are both valid and if you think that Curacao Gaming Commission shouldn't have given them the licenses, you can file a complaint with Curacao regulatory body directly.

Sorry but maybe you misunderstood me so let me clear this up for you. I seen in other posts through out this site that you already know that Direx, N.V owns & operates Bitstarz along with over 30 other casinos as well. You also know that all these casinos share the same master license so yes the license is valid BUT Bitstarz & mBit are not authorized to use this gaming license because they are in breach of contract. I am only stating the facts so as long as mBit and Bitstarz continue to operate without turning GEO Blocking on,they are operating illegally. You should stop all promotions and praise of these guys until they are not in breach. This information should be promoted by lcb because every player has the right to know this and that is the whole point of a player forum like this.

Hello MissBitchcoin,
This is what you've written in one of your posts:
"I have spoke with both mBit and Bitstarz many times and they have made it clear that they will never refund my bitcoin deposits because they do not accept usa players and said I breached their T&C's. "
That's the reason I asked you to provide me with your casino username. I don't know how we can help you if we don't even know who you are.
All the players who post complaints in the casino section are providing us with the details for their casino accounts, so the Casino Representative can look into the claims and offer their side of the story as well; otherwise, everyone can just set up a dummy account and post whatever, without any way for casinos to fight back.
We are only mediators here and we have resolved many complaints posted on the forum, but we have to be objective and in order to resolve all these issues we have to hear both sides of the story before judging someone, which in this case is impossible, since you don't want to provide us with your casino usernames.

Tell me why you ignored the most important issues I mentioned in my previous post? I am guessing you are not a casino player or gambling person because your only concerned with finding out my username instead of researching what i am saying for yourself and not asking Bitstarz because they will obvious lie and say this is not true. I ask myself why sites like casinomeister and askgamblers always ban people who speak out in a respectable manner against the casinos and after a while you begin to see the casino really run everything. Just like at the 2 sites i just mentioned as soon as i provide my username they will provide their very detailed professional fake proof and story and you will fall for it hook line and sinker. Hopefully you see pass their lies and realize I have already come to understand that i know i wont get my btc back so financial gain is not why i am pushing this issue. I want the people out there to know the truth and I have alerted my family members in government and law enforcment here and in Curacao as well that way if anything happens to me they know where to go. I have heard the stories about their trying to silence people just read the Curacao Chronicles for proof.

Dont take anything I said as being disrespectfull because i am not like that, it is just very frustrating when your trying to make another person see that they are being fooled by another person and they dont beleive you. LCB has been around long enough to have heard some of the corrupt things these casinos have done as well as some praises because they do need to stay nuetral.

dear lcb i don't know why missbitchcoin don't want to share her
username...that is not my business but she is right. i am from germany so i got nothing to do with this geo blocking thing at 80% of the casinos around the world. but even I know that bitstarz & mbit casino keep doing this shady
thing since years now. they let players from the us register and deposit without any problems, they cash out smale winnings to make sure
they come back and deposit more and if they winn big they say sorry we don`t acept players from the us and you breached our terms & conditions so your money is confiscated...bye bye. i have read about this shady behavior lot of times at many different places and you know that they keep doing that shit and you do nothing. you don't put a warning on them you don't blacklist them...nothing that is the problem. -

Per my earlier post , duplicate topics have been merged.
@MissBitchcoin just stop! No1 ingorned anything and i already explained in my post what we are doing regaridng all points raised.
You posted in a complaints section without sharing details about your case , and also shown attitude towards the moderators and some other members. You obviously do not want us to look into your case as you were asked a few times to provide your username already.
I mean do you even have a case ? If so then please do let us assist you with your actual case and we will be more than happy to help you.
Back to the main point:
Ive already stated that we are in talks with some of the said casinos and that we are discusing the issue at hand. We argee with the player community that they need to prevent registrations and deposits from restricted jurisditcions. We hope to have some update next week, but understand this is a process and these things can take time. No matter what we will keep our community up to date once we have more info to share.

Ok quick update about MissBitchcoin , not long after my above message I was informed that we received details from the user.
It turns out the user was caught with multiple accounts at Bitstarz. We already took their complaint in July, when they were later banned from LCB for abusing our complaints system ( we do not allow bogus and fraudulent complaints - multiaccounting is a form of fraud ). Complaint details: https://jswqzs.com/onlinecasinobonusforum/player-complaints/bitstarz-mbit-violate-gaming-license-30703#msg463527
No wonder this user was not willing to provide their details... So far we located at least 3 of their accounts at LCB and they all will be suspended shortly.
This complaint will be marked as BOGUS.
P.S.
We have zero tolerance for player fraud, and certainly do not appreciate abuse of our boards for personal gain. We offer FREE MEDIATION and players like MissBitchcoin are doing a disservice to our community and our attempts to help the players. Not to mention wasting our time and undermining our efforts to bring more transparency to this space!
With this said, we will continue as planned and keep discussing these issue with the said casinos and will keep you updated, hopefully mid next week with some good news... stay tuned

Miss bitchcoin is a friend of mine and you should be ashamed of yourself making her out to be a fraud. What concern of it is yours that she had multiple accounts? For all you know she never used a single bonus code and maybe never cashed out so tell me where is the Fraud? I see no fraud just a casino that is very happy for all the money she deposited. If that's how you wanna win by silencing her like this is Nazi Germany then have at it.

This account is now banned as well. Your "friend" has multiple accounts at bitstarz and LCB too. That is fraudlent behaviour.
If you continue creating more accounts at LCB we will be suspending them accordingly.
This topic will be updated with the results of our discussion with mentioned casinos when we have more info to share.

Ok quick update. We received confirmation from Bitstarz management that they are working on solution that will prevent these issues from happening again. Sadly I don't have more information other than that it will involve detecting country IP before making a deposit (?), and was told they will give us heads up once the new system feature is put in place. I was told it will be done early new year, but knowing how developers work it might take bit longer ( right? ).
So stay tuned, and we will update the community when this is placed in motion.
As far as the rest of the SOFTSWISS casinos we will keep bringing this issue to their attention. And finally please read and abide by casino T&Cs, and do your due dilligence before playing anywhere.
