Churchill Downs acquired Big Fish Gaming this year for $835 million to enter the social gaming market by offering free online games. The company has filed a motion seeking the dismissal of a case claiming that its games are illegal.
The Courier-Journal reported Churchill’s success with Big Fish within the first three months generating quite a bit of revenue.
Michigan resident Cheryl Kater filed a lawsuit in Seattle seeking the recovery of $1,000 she lost while playing the games. Big Fish profits with the use of advertising and the sale of virtual credits, which Kater believes is illegal gambling.
Churchill responded with the Washington State Gaming Commission’s opinion that its games do not involve gambling as players are unable to win real money.
Big Fish has nearly 600 employees and has provided over 2.5 billion games to mobile and online customers across 150 countries.

A thousand bucks for nothing? I couldn't understand that. Maybe on the time when decided to play she didn't knew that there is no chance to win anything but in any case this sound very very strange. There are so many places when you could play for fun freely or to gamble your money but at least with some chance of winning....

This is kinda ridiculous. I agree withal the above comments. $1000.00 is a big amount to spend when you can't win real $$$ in return. There are so many other casinos where she can play and win real $$$, so why would she go into such expense to just have fun? We will just have to wait and see how this turns out. I have been...

I have been getting a lot of emails from 'BIG FISH,' but just fun does not interest me when it costs money like that. Glad that I read this article. I'll be watching to see how this Michigan resident Cheryl Kater does with this law suit. Wonder who will turnout to be the 'BIG FISH.'

The lady has to be nuts to gamble $1000 just for fun thats ridiculous if you ask me. why would someone in their right mind just throw their money on a game that you cant win anything on. they need to check that ladys head. I dont think big fish should pay the lady anything back its her own fault for not reading the instructions...

Why would anyone spend $1,000 if they can't win any money? Can you win prizes or something else? I assume she bought virtual credits worth $1,000? My question is why would anyone do that if it is just for fun?
