The civil lawsuit filed by the Borgata Atlantic City against Phil Ivey will continue following federal judge Noel L Hillman’s decision not to dismiss the case.
The case involves Ivey’s edge-sorting on mini-baccarat games while at Borgata nearly one year ago. Ivey and Cheng Yin Sun are being accused of using card imperfections to gain an advantage leading to Ivey’s $9.6 million profit.
Gemaco, Inc, the card manufacturer, is shown as a co-defendant on portions of the civil allegations.
Judge Hillman said, “...at this stage of the proceedings Borgata has pled plausible claims sounding in fraud. The Court will therefore allow the case, in addition to Borgata’s claims against Gemaco, to proceed through discovery, and it will be for the CCC [Casino Control Commission in New Jersey, DGE [New Jersey Division of Gaming Enforcement], and perhaps this Court or a jury to consider the validity of Borgata’s claims and the propriety of Ivey and Sun’s actions.”

Well didnt know baccarat can pay this huge prices. But i wonder what card imperfections exactly means, that they are marked or something. I think if Phil Ivey lose a couple million at a week or night he wants to win the amount minimal 20x back, so this is a way to do it maybe.

But, unfortunately, casino-pitbulls won't let You go clear from this and make every single action to get back what belongs to them. I prefer recommend to play poker to Phil, he's doing better there ;-)

I don't know why this case is not dismissed long time ago. I don't see why Phil should be guilty or feel guilty. It was casinos deck of card and he was playing by their rules, and that was their mistake. I think that this casino should drop all charges and try to not make same mistake. Nothing is perfect. Are there not always going to be some type of imperfection that can be used in the same way. Maybe it is time for the casinos to do more pregame interventions. Maybe these casinos should watch or inspect more closely the items, like cards, they use in their casinos. Perhaps then they wouldn't need to...

I've been very surprised that such a big name in the professional poker like Phil Ivey have been accused in of using card imperfections to gain an advantage. He is a cool, famous and obviously a rich player but I guess the money is never enough. Will be interesting.
